- Oleg Petrovich, the service which you offered is still unusual for an ordinary person, as in the time of Soviet authorities the archives were only governmental, and the enterprises themselves solved the question of keeping the documents basing on the legislation... And now the private archive. Tell, please, about this service. - Using archives is still not a habit for the enterprises, organizations and businessmen. There are a lot of advantages of this service which you can fully realize when you feel the comfort of this service by yourself. The situation when the representatives of rating authority and law machinery suddenly come to the enterprises and withdraw financial and juridical documents, is, unfortunately, perceived as one of the annoying realities of Soviet business. But it appears that in the case of sudden check-up a businessman (an enterprise) may refuse to give the documents on the absolutely legal grounds. For doing so the official documents should be kept in an archive. - Really, in the working process of an enterprise, organization or private businessman there appear a lot of business documents, and, as a rule, rises a problem of keeping these documents. - I would add that this problem is also connected with financial expenses: having a permanent employee for keeping the archive and finding a room for documents which at times may be very considerable. But you will forget about these problems when you hand over the documents to Archive - Service. - What is the legislative basis for this? - First of all there is the Ukraine law "About the National Archive Fund" of 13.12.2001 ^(1) 2888-? (2888-14), where it is said that the archive "provides keeping, calculation and safety of the documents, handed over by enterprises, institutions, organizations, irrespectively of ownership patterns, in an established order for a constant or temporary keeping". Our specialists will exam your documents' value leaf by leaf, and determine which of the documents are of constant or long-term shelf-life and single out the documents with expired term of keeping for destruction. - And what are the shelf-lives of keeping the business documents of the enterprises and organizations? - For the most part of the primary accounting documents the limit is three years. This term is minimal and it is forbidden to curtail it by p. 2, 11 of Indications to the "List of standard documents...", which are confirmed by the order of the Main archive administration at CMU from 20.07.1998 #41. - And do you need to pay for keeping the documents ? - I want to say that it is important to see the difference in the documents: some of them have a historical value and are passed to the State archives according to the respective agreements and others with no such value, which an enterprise or a businessman hands over to the private archive. If the first of them are kept at the governmental expense, for the others you need to pay. - If there any liability for the documents' destruction? - Unconditionally. It is not allowed to destruct the documents by yourself. In such a case the guilty bears criminal liability according to art. 357 Criminal Code of Ukraine which says "abduction, conferment, blackmail of official documents, stamps or seals or owning them by the swindle or abusing of your official position and also its premeditated destruction, damage or concealment, and also actions with the private documents located at the enterprises, establishments or organizations irrespectively of ownership pattern, made by lucrative impulse or in other personal interests, are punished with a fine up to fifty non-taxed incomes or judicial restraint up to three years. - What are the terms keeping documents of natural person - business owners? - Business owners, which realise clearing transaction by payment in cash and cashless ( using charge cards. cheques, counters etc. ) during the selling of goods, catering and services, undertake to provide keeping the using books of record of clearing transactions and pay - books during three years after their finishing, and also to type on registrar of clearing transactions ( except automatic machine of goods' and service's selling ) control tapes and provides its keeping within three years. - What is a term of the limitation of action? - The term of the limitation of action foresees by a law - 1095 days, therefore there is noidea to keep the documents relative to tax calculation over a given term. Though for the history of the development your business may keep as much as you want. - And the last, Oleg Petrovich. You convinced me of all advantages of keeping documents in " Archive - Service ". But if the businessman, for example, wants to see on his hand the copies of returned documents, but to do the paper copies is a complete thing and it will lead to the size of the documents.
